Panorama Panel Privacy Policy

1. Introduction

This privacy policy (the “Policy”) aims to provide you with information about the processing of your personal information in connection with the media and advertising engagement research project (the “Panorama Panel”) that Kantar Media LLC, 600 Mamaroneck Avenue #400, Harrison, NY, 10528 Westchester County (“Kantar Media”) runs in association with the Association of North American Advertisers (“ANA”). This Policy is provided for all participant panelists of the Panorama Panel, which includes participants who directly register on to the panel and other individuals of the household who participate.

Please read this Policy carefully.

For the purpose of this Policy, personal information means any information about an identified or identifiable individual.

2. Who we are

Kantar Media is an independent data insight, research and brand consulting company and exists to provide information to its clients about population level trends in viewing, consumer choices and opinion research. Kantar Media administers the rewards program for your participation in the Panorama Panel. Kantar Media’s website can be located at: www.kantarmedia.com

3. What is the Panorama Panel?

The Panorama Panel is an advertiser-led initiative. The ultimate aim of Panorama Panel is to create demographically representative reports which enable advertisers to better understand the advertisements which the US population have seen when viewing TV or browsing the internet / using apps across different devices (e.g. mobile phones and laptop computers).

This Policy describes the ways in which your personal information is processed to achieve this aim.

4. How to contact us?

If you wish to exercise any of your rights in relation to your personal information (see Section 10 (Your rights in relation to your personal information)), or for general queries and more information about the Panorama Panel, including queries or information relating to incentives, you can contact Kantar Media at: [email protected] or by calling our free toll number +18774569995.

Phone calls you make to Kantar Media panel support may be recorded and retained for 2 weeks for training and quality purposes.

5. Consent for processing your personal information

To process your personal information in connection with the Panorama Panel, Kantar Media will seek your consent to the processing. Where a member of a household directly registers to the Panorama Panel, they are responsible for consenting to participate on behalf of any other members of their household. Shortly after receipt of that consent, we will contact all participating household members to acknowledge this consent.

6. Personal information that is collected about you and the purposes of that collection:

a) “Survey Data” – Information about you and your household

As part of the initial recruitment interview and in follow-up telephone interviews, Kantar Media collects important contact information (such as your name, email, phone number and address), demographic information (such as age group, sex, household income, preferences and interests, the city, town or village you live in), and information about your Internet and TV services (such as which internet and TV service providers you use, and how many Internet-connected devices are in your household).

This information is used to understand how different types of people consume different types of media.

Kantar Media also uses it to make sure that the panel is representative of the US as a whole.
Kantar Media may also collect your race, and ethnic background, for this purpose. This is discussed in more detail below, at Section 6(e) (Sensitive data collection).

Kantar Media will also collect your contact details in order to keep in touch with you during the process of being on the Panorama Panel and for paying you any incentives Kantar Media has offered you to be on the Panorama Panel. Kantar Media may contact you again over time to update this data. Any incentive program is subject to the applicable terms and conditions of our panel. The incentive we offer to you depends on your participation in and completion of surveys as part of the panel. The details of the incentive and its value will be discussed with you during the recruitment process and will be further detailed to you before your participation in a survey. b)”TV Data” – Information about your TV viewing

Kantar Media will ask you to install meters on all TV sets in your household.You will also receive a remote control that you should use to indicate who is watching TV.

The meters on the TV sets will collect a timestamp on a periodic basis which includes a record of the channel being watched, and who is watching TV (based on the members of your household inputting this into the remote control referenced above). This data is used to understand more about the TV programs, commercials, and channels watched by you and your household (including when and how long you watch TV).

c)”Internet Data” – Information about your use of the internet

Kantar Media will ask you to install a simple box that connects directly to your broadband router and collects information about each of your Internet-connected devices. This box is called the Focal Meter.

Kantar Media will also ask you to download some software to each device. For PCs and laptops, Kantar Media will ask you to download a “Browser Meter.” For mobile devices, Kantar Media will ask you to download a “Virtual Meter.” The Browser Meter and Virtual Meter work in conjunction with the Focal Meter to help Kantar Media to understand the websites, platforms and applications you use.

The Focal Meter, Browser Meter and Virtual Meter record how frequently and for how long you engage with websites, platforms or applications from a predetermined list. The list of websites, platforms and applications is available to view at any time in your online Panelist Portal. Your other browsing data is not collected or retained.

Kantar Media will collect the following types of information from the approved list of websites, platforms or applications you visit:

  • Information about the website, platform or applications you use such as:
    • How long you visit for; and
    • How often you visit;
  • Information about the device you use such as:
    • The device model and name;
    • Operating system;
    • MAC address;
    • IP address;

Other unique online identifiers such as Ad ID (Advertising Identifier).

d) Data Exchanges with Online Publishers

As part of the Panorama Panel, we are working with certain digital platforms (the “Online Publishers”), who are able to provide us with information about what videos and ads individuals have seen, as well as demographic information relating to those individuals (together, the “Exchange Data”). With your consent, we will share unique identifiers relating to you and your devices with the Online Publishers in exchange for the Exchange Data. We use the Exchange Data to learn more from the Online Publishers about what you have seen on the Online Publishers’ websites, as well as to get a better understanding of the demographics of Panorama Panel panelists. This exchange of data is explained in more detail below:

    • Why do we want to process Exchange Data?

For some websites and apps, it is not possible to identify the advertisements that you have seen through the Focal Meter and so we rely on data from the Online Publishers themselves.

    • Who are the online publishers?

The full list of participating Online Publishers, which includes Google, Meta (Facebook and Instagram), can be located at the Panelist Portal. This list will be updated whenever new online publishers are added to the Panorama Panel.

    • How does Kantar Media process Exchange Data?

Kantar Media will share encrypted unique identifiers with the online publishers (such as your email address or social media handle) or your device (such as a mobile advertising ID or other unique device identifier associated with the device you use) in a matching process. The online publisher will use this identifier to provide us data that includes your online activity and advertisements that have been shown to you on your device(s) (including time stamps of when such content was shown to you) and share this information with Kantar Media. In some instances we may also receive back demographic information such as age bracket, sex and approximate location (such as region or city).

Kantar Media will then combine the Survey Data, TV Data and Internet Data with the Exchange Data to create “pseudonymised” profiles of members of the Panorama Panel. This combined data will then be modelled to create demographically representative reports for the end clients who are looking to understand the reach of the advertisements, and the demographic make-up of those who view certain advertisements. No personal information is contained in these reports and end clients are only seeking to understand this information at aggregate level.

    • What information is shared with end clients?

Our end clients only receive aggregated reports and models to enable them to understand the reach and demographic make-up of the audience of their advertisements. They do not receive any information that is linked to you or can be used to infer any information about you.

e) Sensitive data collection

As discussed above at Section 6(a) (Survey Data), Kantar Media may also request to collect some personal information that is classified as sensitive personal information. For the purposes of the Panorama Panel, this is limited to your racial and ethnic background. Kantar Media would like to process this data because it helps to ensure that the Panorama Panel is representative of the US as a whole.

Kantar Media will only use this information if you provide your consent. There is no obligation to provide this information and it will not affect your participation in the Panorama Panel. If you choose to provide your consent, you can withdraw this at any time (please see “Withdrawing your consent” at Section 10 (Your rights in relation to your personal information), below).

f)Panel helpdesk data collection

If you contact our helpdesk, we will process the personal information that you provide to us in order to assist you with your request.

7. Data disclosures

We may disclose or otherwise make available your Survey Data, TV Data and Exchange Data in the following ways:

a) To Online Publishers

As discussed above at Section 6(d) Exchange Data, with your consent unique identifiers relating to you will be shared with Online Publishers.

b) To Kantar Media Affiliates

Your personal information will be processed by companies within the Kantar Media Group for panel-recruitment purposes.

c) To Service Providers

We engage other third parties to perform certain services on our behalf in connection with the uses of personal information described in the sections above. Depending on the applicable services, these service providers may process personal information on our behalf or have access to personal information while performing services on our behalf. For example, we may use third-party service providers for hosting purposes, panel-recruitment purposes and fulfilment of prize draws or other incentives.

d) To Other Business Partners

We may share personal information with our business partners for our own commercial purposes. Our business partners may use your personal information for their own purposes, including to send you information about their products and services.

e) In Connection with a Business Transaction or Reorganization

We may take part in or be involved with a business transaction or reorganization, such as a merger, acquisition, joint venture, or financing or sale of company assets. We may disclose, transfer, or assign personal information to a third-party during negotiation of, in connection with, or as an asset in such a business transaction or reorganization. Also, in the unlikely event of our bankruptcy, receivership, or insolvency, your personal information may be disclosed, transferred, or assigned to third parties in connection with the proceedings or disposition of our assets.

f) To Facilitate Legal Obligations and Rights

We may disclose personal information to third parties, such as legal advisors and law enforcement: in connection with the establishment, exercise, or defense of legal claims; to comply with laws or to respond to lawful requests and legal process; to protect our rights and property and the rights and property of our agents, customers, and others, including to enforce our agreements, policies, and terms of use; to detect, suppress, or prevent fraud; to reduce credit risk and collect debts owed to us; to protect the health and safety of us, our customers, or any person; or as otherwise required by applicable law.

g) With Your Consent or At Your Direction

We may disclose your personal information to certain other third parties or publicly with your consent or at your direction. For example, with your permission, we may post your testimonial on our websites.

8. Accuracy

Kantar Media takes reasonable steps to keep your personal information accurate, complete, current and relevant, based on the most recent information provided. Kantar Media relies on you to help keep your personal information accurate, complete and current. If you need to update your personal information, please contact Kantar Media using the details at Section 4 (How to contact us?).

9. Children’s Personal Information

Individuals under the age of 16 will be measured within the Panorama Panel with the explicit purpose of collection and subsequent removal of their viewing data from shared devices (including shared TV sets) in the interest of correctly attributing viewing to individuals 16 years of age and over only. Kantar Media won’t collect data from children under the age of 16 for dedicated devices. In the case of shared devices, Kantar Media will collect viewing minutes and consumption habits of children aged 2 to 15 years for the purpose of identification and removal from data otherwise ascribed to consenting panelists 16 years of age and over.

As discussed above at Section 6(b) (TV Data), households will receive a tablet for the purposes of recording TV Data. Similarly, Kantar Media will also ask households to download some software to each device owned by all members 16 years of age and over for the purposes of recording Internet Data (see Section 6(c) (Internet Data). Kantar Media asks households to indicate via the tablet, whether an eligible Panorama Panel participant is watching TV.

10. Your rights in relation to your personal information

Under certain circumstances, you may have rights under US privacy laws in relation to your personal information, depending on which state you reside in. To exercise your rights over personal information that Kantar Media holds about you, please see Section 4 (How to contact us?).

When you make a request you should include your panelist ID, email address or other identifier so that we can identify you. Please note that in rare cases, if Kantar Media is unable to verify that it is you making the request, you may need to provide further information, such as a copy of a valid government issued ID (such as driver’s license or passport).

You may be entitled to use a third party to submit a request to us on your behalf (sometimes referred to as an ‘authorized agent’ or similar). For this purpose, we will require proof that you gave that third party signed permission to submit the request, which may be in the form of a power of attorney. We may also require additional verification, such as the identity of the third-party individual.

We make the following rights available with regard to your personal information:

      • Withdrawing your consent

Where you have provided your consent to the processing of your personal information, you have the right to change your mind and withdraw your consent for that specific processing at any time. In addition to using the contact details at Section 4 (How to contact us), you can also withdraw your consent through the online portal that is made available to you.

      • Opt-out of sale

You have the right to opt out of the sale of your personal information. In addition to using the contact details at Section 4 (How to contact us), you can also opt-out of sale through the online portal that is made available to you.

      • Right to request access

This is commonly known as a “data subject access request”. This enables you to receive a copy of your personal information and to check that it is being lawfully processed.

      • Your right to request erasure

This enables you to ask for your personal information to be erased in certain circumstances – for example, where the personal information is no longer necessary for the purposes for which it was collected, or where you have withdrawn your consent and there is no other legal ground for the processing. Note, however, that Kantar Media may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.

      • Your right to request that we limit the use of sensitive personal information to that use which is necessary to perform the services or provide the goods reasonably expected by an average consumer, or as otherwise permitted by applicable law.

 

      • Your right to request the transfer of your personal information to you or to a third party.Kantar Media will provide to you, or a third party you have chosen, your personal information in a structured, commonly used, machine-readable format. Note that this right only applies to automated information for which you have provided consent.

 

11.Data retention

Survey Data, TV Data, Internet Data and Exchange Data that is collected will be retained for as long as reasonably necessary to fulfil the purposes it has been collected for (as described above at Section 6 (Personal information that is collected about you and the purposes of that collection).

However, if you choose to leave the Panorama Panel, your personal information will be retained by us for no longer than 12 months. This is to ensure that you are so that you can redeem your reward points.

Please note, however, that Kantar Media may need to retain your personal information for a longer period for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements, or if Kantar Media needs to resolve a complaint that you have made.

To determine the appropriate retention period for personal information, Kantar Media will consider the amount, nature and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes for which Kantar Media processes your personal information and whether Kantar Media can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.

Personal information that is no longer required will be securely deleted or anonymized.

12.Changes to this Policy over time

We may update this Policy from time to time. When we make changes to this Policy, we will change the date at the beginning of this Policy. If we make material changes to this Policy, we will notify individuals by email to their registered email address or through other appropriate communication channels. All changes shall be effective from the date of publication unless otherwise provided.
